Marcus Klee is an experienced trial and appellate lawyer, representing clients in complex and precedent-setting litigation in all areas of intellectual property, with a focus on patent and copyright disputes. His practice includes infringement and validity actions, as well as proceedings before the Copyright Board of Canada. Mr Klee has appeared as counsel before the Supreme Court of Canada, the Federal Court of Appeal, the Court of Appeal for Ontario, the Federal Court of Canada, the Ontario Divisional Court, the Ontario Superior Court of Justice, the Copyright Board of Canada and administrative bodies and arbitration tribunals.
Recent notable matters in the patent litigation area include advising Teva Canada Limited on patent infringement and validity actions, and applications under the Notice of Compliance Regulations. He also successfully represented Bombardier in a patent infringement and validity action. Mr Klee has additionally represented Re:Sound before the Copyright Board of Canada in tariff-setting proceedings, and before the Supreme Court of Canada and the Federal Court of Appeal, as well as before the Federal Court for infringement matters.
