Patrick D Ertel, a partner at Marshall, Gerstein & Borun LLP, has significant experience in the field of IP law. In more than 35 years of practice, Mr Ertel has been involved in nearly every aspect of litigation, prosecution, opinion and transactional work in a wide range of technical areas. He regularly represents licensors and licensees in negotiating and drafting technology-related licence agreements; advises on non-disclosure and employment agreements; and counsels on nearly every aspect of IP transactions, as well as on all manner of patent, copyright and trademark matters. He has also developed highly effective strategies to protect companies against attack from owners of “universally applicable” nuisance patents – both individually and through joint defence arrangements.
In addition, Mr Ertel has cultivated a niche practice counselling companies on IP strategic planning issues, and has extensive experience advising major retailers and wholesalers that sell the goods of others on successful ways to protect themselves against wilful infringement charges. Mr Ertel has also focused on the development of effective IP dispute resolution techniques on behalf of indemnified parties, and has mediated patent infringement disputes and advised clients on implementing cost-conscious, results-oriented litigation tactics.
Mr Ertel has a longstanding AV® Peer Review Rating awarded by LexisNexis Martindale-Hubbell, has been recommended by peers as a Leading Lawyer and has been voted an Illinois Super Lawyer.
Mr Ertel received his JD, cum laude, from the Northwestern University School of Law and his BS, cum laude, in aerospace engineering from the University of Notre Dame.
