BLOG: EU patent court "bound to fail" unless plans are changed, warn European patent litigators

Senior patent litigators in Europe have once again spoken out forcefully against current proposals for a unified European patent litigation system. In a strongly worded press release, the European Patent Lawyers’ Association has described the plans, which are due to be initialled on 22nd December by all member states of the EU except Spain and Italy, as “not at all fit for purpose”. A statement accompanying the release from the association’s president Jochen Pagenberg claims that the current Polish presidency of the EU, the Commission and the European Parliament do not give “the impression that they have paid any attention to users’ opinions”; there...

BLOG: What IBM gets from selling patents to Google

Last week it emerged that Google acquired a couple of hundred patents and related rights from IBM. The company has now done several of these deals with Big Blue and in total has expanded its portfolio by over 2,000 as a result of doing so. As everyone knows, Google needs patents because for many years the company chose to ignore them as a means of building and defending competitive advantage. It’s a lesson that IBM learned many years ago (and which the likes of Microsoft and Apple understood a while back too) and as well as getting freedom to operate and...

BLOG: 2011 - the year it all changed

The latest edition of IP Value - an International Guide for the Boardroom, IAM magazine’s annual round-up of major IP developments around the world, is now available free of charge online. The 2012 edition looks at a variety of topics affecting rights owners in Europe, North America, Latin America, Africa, Asian and Australasia. As such, it is essential reading. It also features a short introduction from yours truly on why 2011 may turn out to be a pivotal year in IP’s development as an asset class in its own right. Here it is, reproduced in full:

BLOG: The IP personalities of 2011

Last year was a big one for intellectual property. In business, finance, policy and law there were major developments that will change the market forever. Given all that happened, selecting 2011’s IP personalities of the year is a hard task. There are just so many candidates; especially because under the IAM blog’s criteria it’s not only individuals that get considered – organisations, countries, sectors and anything else you can think of are all entered into the mix too. However, after long consideration, we have come up with a list of people and entities who we believe made a significant mark on...

BLOG: RPX receives a timely boost as shares are upgraded

RPX shares climbed by close to 9% yesterday following an upgrade from Barclays Capital, which announced it was moving them from a 2-EW rating to a 1-OW rating. Explaining its decision in a briefing paper, the bank’s equity research team stated:
… in our view, the underlying IP sector is one of secular sustainable growth, and we don’t believe there have been material changes in industry drivers that should warrant lower valuations. Recent industry checks, positive meetings with management, and our analysis of key data supporting underlying growth drivers (rising NPE litigation activity, patent asset acquisition prices remaining relatively constant)...

BLOG: As we take a break, here are the top blog stories of the last 30 days and for 2011 as a whole

And so 2011 draws to an end. It’s been an excellent 12 months for IAM. We finish with more subscribers than we have ever had before, as well as a blog following that is far greater than it was back in January. Throw in a sell-out IPBC in San Francisco that saw us ring the NYSE closing bell and there is no doubt that we’ve had a memorable year. Of course, none of it would have been possible without the subscribers, delegates, advertisiers and sponsors who help to keep us in business: many thanks to each and every one of you....

BLOG: Business method patent problems down under (and maybe in the UK and Canada too)

I received an email late last week from Mark Summerfield, who writes the excellent Patentology blog which looks at all things IP from an Australian perspective. He has identified what he thinks is a major area of concern with the way IP Australia, the patent issuing authority down under, deals with applications relating to business methods. This is what he has to say:
There are disturbing things going on within IP Australia which, in my view, are not getting the international attention they deserve. Over the past couple of years, the Patent Office has, for all intents and purposes, been...

BLOG: Apple may never be better placed to negotiate a beneficial end to the smartphone wars

So what started out as a case against HTC at the ITC built round 10 patents ends up with Apple prevailing on just one. The victory Apple secured yesterday means that the Taiwanese Android manufacturer will be unable to import phones using technology covered by the patent into the US after the middle of April 2012. But the likelihood is that HTC and/or Google will develop a work-around solution before then and nothing much will change (apparently, it's done already).
As Apple contemplates its next move it’s worth remembering that in the past HTC has made it pretty clear that...

BLOG: In suing Google, BT will hope to avoid its fate in the last high-profile patent case it fought

The news that BT has entered the smartphone wars in order to sue Google for myriad alleged Android infringements of six of its patents sends me back to the last time BT got involved in a high-profile US patent litigation. That was 11 years ago, when it sued Prodigy in New York, claiming that the ISP had infringed a patent BT owned which covered hyperlink technology. The patent in suit was not core to the company in any way; in fact, its existence had only been discovered during an audit of its portfolio. The case did not end well for BT,...

BLOG: There'll be no deal on a unified patent system for Europe, says EU presidency

In what will be welcome news for many European patent litigators and judges, the Polish presidency of the EU has stated that it is unlikely a deal to create a unified patent court will be agreed this year. However, it's not because all of a sudden negotiators are worried about the way the proposals are drafted; instead, it's because there is still no agreement on where the court will be situated. "Essentially the whole package is negotiated, it’s final ... Nevertheless, due to the resistance to compromise of one or two member states, we will not decide this year on the...

BLOG: As the Chinese embrace IP, foreign companies are still failing to to do the same in China

There are few people based in Europe who know more about the IP marketplace in China than Ian Harvey, chairman of the UK’s Intellectual Property Institute. Spend any time with him and very quickly you will discover his conviction that the bad press China gets with regard to IP does not tell the full story. Having visited China myself a few times now, it’s a view I share.
While not wanting to downplay the IP problems that foreign companies do face, if we only focus on these we miss a hugely important developing story – the way in which the...

Despite some less than flattering evaluations of the quality of its patent portfolio, RIM undeniably maintains some highly valuable assets. Go to any conference or seminar and you will likely still see BlackBerrys outnumbering any other type of mobile phone, and that must count for something. RIM’s flagship product is still hugely popular in the face of huge competition, and BlackBerry OS is the software that runs 11% of the world’s smartphones. In light of this,...

BLOG: Kodak should not count on a big patent sale to save the day

Kodak’s agonising descent into bankruptcy finally ended earlier today when the 130-year old company filed for Chapter 11 protection in New York. Since August Kodak has been attempting to sell 1,100 patents – a portfolio which some commentators have estimated could be worth as much as $3 billion. In recent weeks, the company has also filed a series of lawsuits against the likes of Samsung, Fujifilm, Apple and HTC, alleging various infringements of its patent rights.
The legal action was launched after a reorganisation at Kodak which put IP into its own business unit. A spokesman explained: “It's not just...

BLOG: CPA's $1.5 billion sale is another sign that IP has become a mainstream business

Yesterday CPA Global issued a press release confirming that it is to be acquired by private equity firm Cinven. Although the sum involved has not been disclosed, Bloomberg reports that the deal values CPA at £950 million ($1.5 billion). In January 2010, when mezzanine finance outfit ICG acquired a 49% stake in the global IP outsourcing business, CPA’s overall valuation was set at £440 million. So that means it has doubled in value in two years. If that does not tell you something about changing perceptions of IP then I do not know what does.

A recent study suggests that companies are turning to their intellectual property to provide a tonic that can sustain them through economic uncertainty. But are they giving undue priority to enforcement at the expense of other methods of IP value creation?
At the end of last week, CPA Global outlined some of the results of its third State of the IP Industry Survey. The study asked a range of in-house IP professionals and IP lawyers about trends and developments they had noted in IP practice during 2011.
In total, 78% of corporate IP professionals surveyed stated that budget control had been one of...

BLOG: Nokia again shows that working with NPEs is just another option for operating companies

This is the second time that Nokia has done a deal with an NPE recently. Last September it sold a portfolio of 2,000 patents and related rights to MOSAID. Unlike that deal, however, there is no indication that Nokia will have any on-going financial interest in the licensing...

Although Acacia has worked closely in partnership with SMEs, and more recently larger corporations and universities, to help them monetise their IP, this is the first time it has gone out a bought a whole company. That it has financed the deal using straight dollars and cents shows just how far it has come. Little more than three years ago, its whole business was not even valued at $100 million.

And, once again, it was a record number: 6,180 - up 5% on the 2010 total. Just to confirm that the status quo is alive and kicking, Samsung came in second (4,894), just as it has done since I can remember. However, elsewhere in the top 10, there has been some movement. Microsoft, third in 2010, is down in sixth place this time, having seen a decline of over 700 in...

As the blog explains: “It is a central policy of the Chinese government that foreign investment must be made in a manner that is consistent with Chinese policy and in a way that will promote China's development. China therefore follows a policy of guided investment, and the Catalog (sic) is the guide.”
The Out-Law blog explains that within the catalogue there are four categories:

BLOG: Could co-operation help pull pharma back from the cliff edge?

AstraZeneca has announced that it is to shed over 7,000 jobs worldwide; this is in addition to over 20,000 jobs that it has already cut since 2007. And the UK-based company is not expecting a reversal in fortunes any time soon. According to an official statement the outlook is gloomy: “Revenue in 2012 will continue to be adversely affected by government interventions on pricing, and ongoing generic competition, including the anticipated loss of market exclusivity for Seroquel IR and Atacand in global markets, as well as for Crestor in Canada.”

This news is unlikely to come as a huge shock...

BLOG: When it comes to the Facebook IPO it's all about intangibles and IAs

There will be an awful lot written about the Facebook IPO over the coming weeks and months by people a lot more qualified than me to be making comments. However, it would be wrong not to point out one very obvious aspect of the planned float: the extent to which the success of the Facebook business is dependent on its ability to leverage intangible and intellectual assets. Looking through the company's S1 filing that was made yesterday, what shines through is the importance of maintaining and building relationships with users and advertisers: without the first, the second will drift away. What’s more,...

The latest issue of IAM is now available to subscribers online. Our cover story, written Australian patent attorney Mark Summerfield, who is also the author of the Patentology blog, takes a detailed look at the smartphone patent wars. With cases being fought around the world and different companies employing different strategies as they seek to gain the upper hand, Mark explores how things have got to where they are and what may happen next, as well as explaining why Steve Jobs’ threat of “thermonuclear” attack against Android is very unlikely to pay dividends for Apple.
BLOG: The NPE reality is very different to the media myth

Yesterday this blog discussed a paper produced by Tom Ewing and Robin Feldman for the Stanford Technology Law Review entitled "The Giants Among Us". It is, we stated, a serious piece of work looking at the alleged effect that a certain kind of NPE - the so-called mass patent aggregator - is having on the US patent marketplace. The paper is a temprate and important contribution to the debate about NPEs in the US. While people might not agree with the paper's conclusions, they invite a sober response and may open up a debate that has become pretty sterile - with anti-patent rhetoric often...

Tom Ewing is a regular contributor to IAM magazine and this blog. His areas of speciality are NPEs, Intellectual Ventures in particular, and the privateer model of assertion, through which IP owners (both NPEs and operating companies) use third parties to manage/enforce patents on their behalf. Ewing has got together with Robin Feldman, Professor of Law & Director of LAB Project, UC Hastings Law, to pen a paper for the Stanford Technology Law Review. And The Giants Among Us is one of the most important contributions to the debate about NPEs, patent aggregators and the state of the US patent marketplace that...

BLOG: Google treading the warpath as it puts Motorola purchase to the test

Motorola Mobility has filed suit in the Southern District of Florida this week against Apple, accusing the company of infringing six of its patents in the iPhone 4S and iCloud products.

Moto has been embroiled in various suits with Apple, but this is the first since Google’s proposed $12.5 billion acquisition of the company was announced last summer. While that purchase still awaits the seal of approval from US antitrust watchdogs, the takeover agreement reached between the two companies is already in place. One of the clauses of that agreement is that Motorola must obtain permission from Google if it...

BLOG: US politicians will not risk electoral unpopularity over IP

The derailment of the SOPA and PIPA bills in the US Congress last week has been disappointing news for copyright holders in the media and entertainment businesses that the laws were intended to protect. The proposed legislation has not been killed off entirely, but what may concern all IP owners – even those opposed to SOPA and PIPA - is the way that the controversy has revealed how quickly US politicians will change their minds when faced with an apparently unpopular policy.

The Protect IP Act (PIPA) was first introduced to the US Senate in May last year by Democrat...

BLOG: New pan-European patent system is likely to be delayed "for at least a few more months"

A final agreement on the creation of a unitary patent litigation system that would cover at least 25 of the 27 EU member states is set to be delayed by months, according to a report in yesterday’s Financial Times. The cause of the hold-up is the dispute between France, Germany and the UK over where the central court should be located. In the proposals which were expected to be signed-off at a meeting of the EU Competiveness Council in December, Paris was named as the venue, but neither the UK nor Germany would agree to that. The former wanted London, while...

InterDigital’s share price dropped sharply yesterday after the company announced that it was ending its attempts to find a buyer for its patents and would return to licensing as its key IP revenue generation strategy.
Some have characterised this news as yet more evidence of the bursting of the patent bubble. The important message from the story, however, is that we still have some way to go before increased interest in IP is paired with widespread, sophisticated understanding of IP as a business asset.
A sale is, by its very nature, a one-off event; the success of a patent sale cannot...
