The remarks that David Kappos made following his inauguration as Director of the US Patent and Trademark Office earlier this month were politically astute. Addressing a live audience of office staff, as well as tens of thousands of IP professionals and other observers further afield, Kappos was quick to identify many of the perceived problems at te USPTO people have complained about for a while now, while pledging to listen carefully as he seeks to solve them. His predecessor Jon ...

Just before I went on holiday I wrote a piece for PatentlyO about patent application trends and their consequences in various parts of the world. I wrote that Australia was one country in which a downturn in applications had led to staff being laid off in the national patent office. I have since received an email from IP Australia's Victor Portelli explaining this is not, in fact, the case: "While it is true that IP Australia (which includes the Patent Office) did terminate IT ...

A list produced by patent information resource Patent Buddy reveals that Oblon Spivak McClelland Maier & Neustadt secures more US patents for its clients - or at least those among the leading 300 recipients - than any other American law firm. In 2008, the Arlington, Virginia, based firm achieved 2,853 grants for companies in the top 300, that's over 700 more than second-placed Sughrue Mion. Although this is clearly very interesting information, what I would also like to ...

The ICAP/Ocean Tomo open IP auction planned for Paris at the beginning of November has been cancelled, according to a report posted on the website of Inventors Digest magazine. The news follows the dismal results achieved in the first auction the company held, which took place in Chicago last month, and the hugely disappointing returns from the final auction that Ocean Tomo organised prior to selling its transactions business to ICAP in June. According to ICAP/OT president Dean ...

This year, we were promised what the weather forecasters called a barbeque summer in the UK. Those who know the climate of these islands will be unsurprised to learn that the barbeques have been few and far between over the last few months. Instead, it has, as usual, mostly poured with rain. Today the Wild family escapes the downpours (and the depressing cricket news from Headingley) to head to the sunny south of Italy. Thus, you will hear no more from me until the last ...

A little snippet for you. I have just heard from Ciaran McGinley, the Controller of the European Patent Office, that the number of applications it has received so far this year is down 8%. By way of contrast, for the six months to March 2009, applications to the JPO were down 6%; while in March PatentlyO projected a 10% decline in first filings at the USPTO. Internationally, PCT filings are down by 5%. Ouch!

In response to the recent post I did on a state-run NPE being set up in Korea, I got a note from Nick Gibson, Director of Product Development for the Intellectual Ventures Invention Development Fund. Nick makes some observations about what the Koreans are seeking to do which I think may well be right. I know from experience that it is not easy setting up a network of inventors or sourcing high-quality inventions. As my colleague Patrick Ennis often says, one of the ...

There has been a very heavy Asian element to the IAM blog recently. It's not a surprise really as I was over in Singapore last week attending the excellent Trading Ideas conference organised by the country's IP office. Shamefully, it was the first time I had been to Asia in a work capacity for nine years. But though I was there for only a short time, I learned a hell of a lot. And probably the single most important lesson was just how committed the governments of the ...

The Korean Intellectual Property Office has announced plans to tackle the country's patent deficit that in 2007 saw local companies pay out close to $3 billion more in licensing fees than they received in return. In order to turn the tide, KIPO has proposed the establishment of a fund that will, to all intents and purposes, work exactly like a non-practising entity. In other words, it will buy up or license-in suitable pre-patented ideas to take through the ...
